General Provisions

The following terms and the following conditions ("Terms of Sale") shall apply to all sales of branded products Francesca Mambrini ("Products") on the web portal www.francescamambrini.com ("E-shop").

The products displayed on the E-shop are sold by PVS SERVICES ITALY SRL ("Merchant"), a limited liability company with registered office in Italy, P.le Balestrieri 31 / A, 43122 Parma, capital stock of € 100,000.00 , FISCAL CODE and VAT NUMBER n.  02647480348.

The Merchant reserves the right to modify, in whole or in part, the Conditions of Sale, in its sole discretion, applying new conditions of sale from the date of their publication on the E-shop. The terms of sale applicable to any order placed on the E-shop are those in force at the time of the order.

The order placed through E-shop by the user ("Customer" or "You") constitutes full acceptance of the Terms and Conditions of Sale and the Merchant Privacy Policy  insert hyperlink], which is an integral part of these Conditions of Sale. The sections "Delivery products" and "Terms of Use E-shop" [insert relative hyperlinks] also form an integral part of these Conditions of Sale. The refusal to accept the Conditions of Sale and the Merchant Privacy Policy, prevents the customer to make any order through E-shop.

Purchase Suitability

Products can be ordered through E-shop only by persons who (i) have reached the age of majority (eighteen years), (ii) have the capacity to act, and (iii) living in Italy / in a Member State of the 'European Union and (iv) are not working in  trade, craft or professional business .

Children under eighteen years of age and those deprived of legal capacity to make  a contract, they can place an order by a parent or  tutor acting on their behalf.  All orders made in contravention of this provision and all contracts concluded on the basis of such orders will be without any effect.

By placing the order through E-shop, Customer represents and warrants to be  the final consumer, and that will not deliver, distribute or sell the Products for commercial purposes.

Conclusion of the Purchase Contract

In order to order one or more products, you must register on the E-shop and create your own personal account.

Upon completion of the registration of your account on the E-shop, you can fill in the order form available on-line and send it to the Merchant.

The submission of an order form to Merchant constitute an offer to purchase the Products selected. This offer will be treated by the Merchant in accordance with the Conditions of Sale. The Merchant may accept or decline the offer of purchase by you sent, according to his own entrepreneurial self-determination and availability of products required (see item 4 below). The purchase contract will be made only upon acceptance of the purchase offer by the Merchant, by sending an order confirmation to the email address notified by you in the Order Form. By submitting an order form, you declare to be aware that this involves sending an obligation to pay the price of the selected products, as detailed in Article 5 below, in the case of acceptance of the Order Form by the Merchant and the subsequent conclusion of purchase contract.

By submitting an order form, You are responsible for the accuracy of the information provided and you allow the Merchant to process your personal data, necessary for proper performance of the service, in accordance with its Privacy Policy .

Availability of the Product

Although the Merchant shall do everything possible to make the product supply selected by you in the Order Form, his commitment is inevitably subject to the availability of the Product.

For these reasons and in exceptional cases may accidentally happen that the Merchant is not in the ability to deliver the products required because, for example, have been carried out on-line multiple orders that led to the depletion of stocks. In such cases, the Merchant will promptly contact you at the email address supplied in the order form to warn you to the unavailability of the Products.

If the Products are found not available for the reasons given above or in other cases of unavailability of the Products, subject to the other user rights granted by law, the Merchant will immediately notify you by e-mail suggesting, alternately and his choice (i) the repayment of the total amount due, representing the price of the Products, the shipping costs, if applicable, and any other additional cost, if already paid; or (ii) the supply of various products of equal or greater value, subject to payment, in the latter case, the difference; or (iii) where it is possible a  restocking of the Products, an extension of the delivery date, specifying the new delivery of the Products.

Prices, Taxes, Shipping Costs

All prices shown on the pages relating to the Products E-shop are inclusive of VAT and all other taxes. Shipping costs are entirely borne by the Merchant in case the delivery address is within the territory of the Italian State. For details on shipping costs related to deliveries to be made in the territory of the Member States of the European Union, please see "Shipping Products", article 1.  The total amount to be paid by you, including the price of the product / the chosen / s, tax and possibly shipping costs ("Total Amount"), we will again be notified before the order  formalization through submission of the Order Form.

The Merchant reserves the right to change, at any time and without prior notice, the prices of the Products, provided that the amount charged will be shown on the E-shop at the time of order by you. In the event of changes in the VAT rate applicable in the period between the date of making the order and the date on which the Merchant will be in a position to its shipment, it will be the Merchant to contact you to obtain a confirmation of the order . If the Merchant fails to obtain your instructions, will cancel the order and it inform you of the cancellation.

Payment Terms

The Merchant accepts the following credit cards: Visa, Mastercard.

Please note that the customer  choice of method of payment transaction will result in an extension of time for delivery of the Products, which will only improve as a result of the payment of the same. Payment by credit card Visa MasterCard will be addressed for the purposes of the transaction with a secure connection to the web pages of Banca Sella and PayPal, entities that manage online payments to the Merchant.

For each sale, the Merchant will issue special tax document, the name of the natural person who made the order, which will be delivered to the address specified by the Customer on the Order Form.  The Customer is solely responsible for the accuracy and truthfulness of the information provided to the Merchant for tax purposes.

Mode and Delivery Times

The Merchant ship the products requested by you entrusting them to carriers that offer efficiency and quality of service. Once   delivered the Products to the carrier, the Merchant will send you an e-mail confirming the shipment to the email address notified by you in the Order Form. In any case, the transport document is  the proof of delivery to the carrier.

Products will be shipped to your address on the Order Form. The amendments concerning the place of delivery (compared to the one originally stated), if required by the customer subsequent to the delivery of the Products to the carrier, will generate additional costs that will be borne by the customer.

For information on delivery times, please see "Shipping Products", Article 2. The Merchant will make every reasonable effort to provide the Customer with the Products required in the shortest time possible and at the latest within thirty (30) days from the date of conclusion of the contract to purchase the Products (the "Date of Termination of Contract" ). However, the timing of supply may depend on factors external to the will of the Merchant. Each delivery time indicated by the latter to the customer and no more than thirty (30) days from the date of conclusion of the Contract must, therefore, be regarded as merely indicative and not mandatory.

If the delay in delivery would exceed 30 days from the date of conclusion of the Contract, the Customer may request the Merchant to make the delivery within an additional period designated by him and appropriate to the circumstances. If the additional period allowed to expire without that the Products are delivered, the Customer may withdraw from the contract by written notice with the provisions laid down in article 8.

In case of delivery inside the Italian territory, the delivery will be held in 1/2 working days. But, in case of some not well connected areas, the delivery should require 2 more days.

The standard delivery is free for Italian and European Community deliveries.

Delivery costs for all the European countries are the following:

 Shipping

 The Merchant warrants that all orders shipped are always covered by insurance against the risks of transport, loss and breakage of the Products in accordance with the conditions of carriage of carriers. In any event , the customer is in charge to verify that the products are delivered in perfect condition. If the Customer at the time of delivery, should find errors in the sending of products or the package received is visibly damaged, the Customer must set out those circumstances in the delivery of the carrier with the words "control reserve", detailing  as precisely as possible the findings. Within the next 24 hours, the customer shall notify the incident to the Merchant by e-mail at the address customerservice@francescamambrini.com  or telephone number +39 0521.976910.  If the customer receives their order without showing obvious abnormalities, the Merchant shall not be held liable for any damage resulting in the transport of the products.

Right of Withdrawal

The customer not satisfied with the products received may withdraw from the  purchase contract of the same products without giving any reasons within fourteen (14) days from the date on which it has acquired the physical possession of the Products ("Withdrawal Period").

Users who own a Francesca Mambrini My Account can return one or more purchased products by filling in the return form available on “My Account – My Orders” page within 14 working days of the delivery date. For users who have placed an order as a “guest” i.e. who don’t have a Francesca Mambrini My Account it is possible to return one or more purchased products by filling in the return form available here ...... Products returned from the same order must be sent together in a single consignment. The Merchant do not accept returns from the same order arriving at different times. The company reserves the right to refuse returns communicated or dispatched late, or garments not in the same condition as when delivered. By entering the order number in the Returns Form and carefully selecting the specific product/s to be returned, a request will be automatically generated and The Merchant will arrange collection by the carrier FedEx.

The Customer shall return the products to the Merchant for which he has exercised his right of withdrawal within fourteen (14) days from the day you sent the Merchant his decision to withdraw from the contract. To this end, the customer will ship the products to the address of the registered office of the Merchant, as specified in Article 1. Unless otherwise stated, the costs for the return of the Products shall be borne by the Merchant.

From the receipt of the products to their delivery, the customer is obliged to maintain and preserve the products, together with the original packaging, with the utmost care and diligence. Products must be returned in their original packaging, along with all the tags that were attached to them at the time of delivery. The customer is responsible for the decrease in the value of the products resulting from the manipulation of the same other than that one  necessary to establish the nature, operation and characteristics of the products themselves.

Receiving notice of the withdrawal, the Merchant shall without undue delay and in any event within fourteen (14) days of such notice, to repay the customer the total amount paid. Unless otherwise agreed taken with the Merchant, the refund will be made using the method of payment used by the customer for the purchase of the Products. In any case, the customer will not incur any fees as a result of such redemption.

All communications to the Customer relating to the exercise of the right of withdrawal, including the communication of confirmation of receipt of the withdrawal exercised, will be made by the Merchant by e-mail to the email address provided by the Customer on the Order Form or, if different, to the email address specified by the customer in the notice of withdrawal. Further variations of the address is not disclosed to the Merchant will not be opposable to this.

Products Warranty Sold Through The E-Shop Il Merchant attua una politica di controllo qualità, finalizzata a verificare che i Prodotti venduti siano sicuri, non pericolosi e non difettosi, in conformità a quanto disposto dalla legge.

The Merchant shall implement a quality control policy, aimed at verifying that the products sold are safe, non-hazardous and non-defective, in accordance with the provisions of law.

The guarantee of conformity of products sold is paid pursuant to the rules contained in Legislative Decree n September 6, 2005. 206 (Consumer Code) guarantees in the sale of consumer goods.

The Merchant will not be responsible for any damage arising from misuse or wear and tear, improper handling and maintenance of the Product. The warranty does not apply in the case of intervention of factors unrelated to the normal use of the Product. The guarantee does not cover the defects  already known to the Customer at the time of purchase.

It is for the customer who has opted for the return of the nonconforming Product instead of replacing the same and agree to return the Product, including via e-mail, with the Merchant within 10 days from the date of the complaint of the lack of conformity the mode of delivery and return of the Product. The Merchant, received such notification, the Customer shall indicate the mode and place of delivery of the Product in the same terms.

Once received the product, the Merchant will provide to the relevant standards and quality control, also using the facilities of the manufacturer and, if the lack of conformity was found, the client will send a product replacement. If, as a control, the product was not found to be suffering from lack of conformity, the Merchant will inform the customer about the costs involved in replacement. Will be charged to the Customer the costs related to the transportation of products which do not show any lack of conformity.

Applicable Law and Jurisdiction

These Conditions of Sale are governed by Italian law. This means that the contract for the purchase of products on the E-shop and any dispute or action arising out of or connected with this will be subject to Italian law.

All disputes relating to these conditions of Sale will be donated to the jurisdiction of the Court of the place of residence or domicile of the customer, if located in the territory of the State.
